1. Acceptance of Terms

By creating an account or using the Foresight platform, you agree to these Terms of Service. If you do not agree, do not use the platform.

2. Platform Description

Foresight is a sports prediction tracking and analytics platform. The platform allows users to record predictions using simulated currency (“$FORE Points”), view performance analytics, participate in leaderboards, and engage with community features including crews, referrals, and achievement systems.

3. $FORE Points

$FORE Points are virtual platform credits used for engagement tracking within the Foresight ecosystem. $FORE Points:

• Have no cash value and cannot be redeemed for real currency
• Cannot be purchased with real money (platform subscriptions provide access to features, not points)
• Are non-transferable outside the platform
• May be modified, adjusted, or reset at the platform’s sole discretion

The platform may, at its sole discretion and without any obligation, explore future utility for accumulated points, which may include but is not limited to conversion to blockchain-based tokens, governance participation, or other engagement mechanisms. No representation, warranty, or guarantee is made that points will ever be convertible to any cryptocurrency, digital asset, or item of monetary value. Users should not acquire or accumulate points with any expectation of financial return or profit.

If a blockchain-based token is created in the future, distribution terms, eligibility criteria, conversion ratios, and vesting schedules will be determined at that time and may differ materially from current point balances or accumulation rates. The platform reserves full discretion over all aspects of any future token distribution.

4. Not Financial Advice

Nothing on this platform constitutes financial advice, gambling advice, or a recommendation to place real-money wagers. The platform tracks predictions using simulated currency for entertainment and analytical purposes only. The platform does not facilitate, process, or intermediate real-money gambling transactions.

5. User Accounts

Users may create accounts using email/password or Telegram authentication. You are responsible for maintaining the security of your account credentials. You agree to provide accurate information and not create accounts for deceptive purposes. One account per person.

Pick records are permanent and public. Picks cannot be edited or deleted after submission. This is a core feature of the platform’s transparency commitment, not a limitation.

6. Acceptable Use

You agree not to:

• Create multiple accounts to manipulate leaderboards or referral systems
• Use automated tools to submit picks or interact with the platform
• Harass, abuse, or threaten other users
• Attempt to exploit, hack, or reverse-engineer platform systems
• Impersonate other users or platform staff
• Engage in any activity that violates applicable laws

7. Subscriptions and Payments

Premium subscriptions are available via Stripe (credit card), Telegram Stars, or TON blockchain payments. Subscriptions provide access to enhanced platform features and do not grant ownership of any asset, token, or equity.

Refund policy: Contact support within 7 days of purchase for a refund if premium features are not functioning as described.

8. Intellectual Property

All platform content, code, design, and branding are owned by the platform operators. Users retain ownership of their prediction data and written content (pick reasoning, crew descriptions, etc.) but grant the platform a non-exclusive license to display and use this content within the platform.

9. Data Collection and Privacy

We collect:

• Account information (email, username, Telegram ID)
• Prediction data (picks, records, performance metrics)
• Usage data (page views, feature interactions)
• Payment data (processed by Stripe/Telegram, we do not store full card numbers)

We use this data to:

• Operate and improve the platform
• Send marketing communications (only with your consent, opt-out available)
• Generate aggregated analytics (no personal data sold to third parties)

If you opted into marketing communications, you can opt out at any time through account settings or by contacting support.

10. Limitation of Liability

The platform is provided “as is” without warranties of any kind. We are not liable for losses resulting from platform downtime, data inaccuracy, pick outcomes, or any decisions made based on platform data. Maximum liability is limited to the amount paid for subscription services in the preceding 12 months.

11. Termination

We reserve the right to suspend or terminate accounts that violate these terms. Users may delete their accounts by contacting support. Account deletion removes personal data but pick records remain on the public leaderboard in anonymized form.

12. Modifications

We may update these terms at any time. Continued use of the platform after changes constitutes acceptance. Material changes will be communicated via the platform or email (if provided).

13. Governing Law

These terms are governed by the laws of the State of Florida, United States. Any disputes shall be resolved in the courts of Pinellas County, Florida.
